CreateOnline Ltd is a Company registered at Companies House in England as Registration Number 04620957, at Registered Address: The Mansion, Bletchley Park, Milton Keynes, MK3 6EB. ‘Printree’ is the on-line trading name for CreateOnline; ‘Prints Place is simply the name of the web based print-shop. For simplicity, ‘CreateOnline’ is used throughout these Terms and Conditions.
This Agreement is a legal document, which sets out your rights and obligations, and those of CreateOnline, in relation to the services offered by us through this site or any other CreateOnline sites to which we linked. Viewing of all CreateOnline sites itself is free; but when customers register through the site, they agree to the terms of this Agreement, and they re-affirm that agreement every time they use the CreateOnline services.
CreateOnline provides access to and use of this site subject to these site terms. 2.7 Applicable Law
CreateOnline is a company registered in England. As such, English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.
If any of these terms contained herewith should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining site terms shall survive, remain in full force and effect and continue to be binding and enforceable.
2.8 Making a contract with us
To register for CreateOnline services, you must be over the age of 18 years and be legally able to enter into contracts for goods and services that you may buy here. We request that you agree to register for CreateOnline sales using your correct name, address and any other requested details.
You may be asked to enter credit, debit or charge card details. You must ensure that (i) you are fully entitled to use that card at the time when you provide those details to CreateOnline; and (ii) when you use the card, the card has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately.
2.9 Misuse of our site
CreateOnline reserves the right to suspend or terminate any customer’s account, which, is, or appears in our absolute discretion, to be, in breach of any of the provisions of this Agreement.
2.10 When will you be charged?
Your credit or debit card will be charged immediately when your order is placed.
2.11 Purchases Taxes & Duties
The United Kingdom’s Value Added Tax (VAT) is charged on all goods and services where applicable and at the prevailing rate. Customers are automatically responsible for the payment on all applicable duties for deliveries outside the European Union.
Descriptions of goods and services included in the CreateOnline site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images may vary very slightly from the way they appear on the screen.
The images and designs available on the CreateOnline website are the property of CreateOnline, their partners, or their respective copyright owners, and are used by CreateOnline pursuant to express authorisation from copyright owners or their agents.
You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to CreateOnline are vested in CreateOnline or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever.
In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an Interim Injunction will exist. Such an Interim Injunction made by a court, will prevent any further use or distribution of the image(s) in question, until a final court hearing where the court will make a decision on all the facts.
CreateOnline will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused. CreateOnline’s liability under this Agreement (whether arising in negligence or otherwise), is limited under any circumstances to the lower figure of (i) £200 or (ii) an amount equal to the value of the customer’s net order. This does not affect your statutory rights as a consumer.
Nothing in this Agreement limits CreateOnline’s liability for personal injury or death resulting from our negligence.
2.16 Reasonable Control
CreateOnline shall not be liable for any failure to perform its obligations under this Agreement if caused by matters beyond our reasonable control.
2.17 Changes to this Agreement
CreateOnline reserves the right to change the terms of this Agreement from time-to-time, and to post a revised or new version on the website. The new version will take effect from the day of posting on the site. The range of images together with information on price, finishes, delivery costs and exchange rates etc are also subject to change without prior notice.
